2.Stay updated

Our services keep you daily updated regarding business ideas, news, events, professional topics to improve your business and marketing skills. you can also suggest us by your feedback to improve our services in better way and we will use that to develop new features and activities. We also conduct research and survey by our services to develop new features and updation. we use your information to update you any post in which you tagged by your friends with their profile photo and post shared by them. This tagging option is available in setting option from which you can select your list friends that can tag you in their post. we also update you for any event having in your localities, that’ why we keep continue record of your location tracked by our GPS.

3.Display your Ads measure

We use your information to measure the effectiveness of Ad posted in graphical and calculated form which shows your views, clicks, reach, share, likes, comments, impressions, run time. The above calculation will be done on daily basis and your graph will show your Ad performance how they are reaching peak on daily.

4.Data safety and security

We use your information for verification to provide safety and security of your data. we try to investigate the user who try to harm our system or violets our terms and condition. we have technology with double security, automated system and team of skilled engineers by which we keep your all information safe and secure. If anyone tries to violets the rules then action will be taken against them.

How we Share and disclose Information

1.Sharing your control on services

You have complete control of your information you want to share with people. you direct us to share your personal information as your choice that may be public, personal and social. Whatever network you select will see your all activities done on Talkfever like post share, like comments, Ads posted etc. When you select public network then all the users of Talkfever can see your activities whether they are your friends or not. When you select personal network then your activities will be seen by your direct friends(friends made with your links) and when you select social network then your activities will be visible to those who are unknown to you but you have chosen them as your friends by accepting or sending friend request.

2.Content shared related to you

If anyone shares or posted any content related to you on your timeline then it will be visible by your network whatever you have selected in your settings for example if you comment at any post of your friend then that will be visible by all the friends of your friend and you will also be notified about each reaction on that post by anyone. If anyone shares your post that will also be notified to you and if you send or receive any message the you will receive all the reactions on that.

3.Information when you are online

Talkfever will show your status online to your network on their timeline or on chat box or any other app that will be integrated to us. This will help your friend to communicate with you when they will see that you are online.

4.Information shared with other apps, website or other parties integrated with us

Talkfever will share your information with apps, website and other apps that are integrated to us i.e. when you install that apps or click on that website links then your profile information will be sent to that apps and websites depends on your permission. Also, whenever you play a game in our fun zone section with your Talkfever’s friends then your information will be shared with that game developer and game developer will be notified about your all activities on Talkfever. Also, that game developer may receive your friends list but not any other information related to your friends.

5.New control

If Talkfever transfers their controls to any other party then all of users information will be shared with them but only on that condition when they are agreed with our privacy policy.

6.Share to service provider

We work with service providers who help us to improve and provide our products and to provide the services all over the world. Also, we don’t sell any information to any of our party in any manner and even our partners are strictly restricted to use or disclose any type of data we provide. we provide information to our partners who uses our analytical services to understand how our users are engaged in different activities on our timeline i.e. how you and your responds to your posts and their posts like comment, share, like in graphical as well as analytical manner to understand your interaction on your page and on your friends page.

• We also provide information to advertiser who creates their Ads for promotion with detailed information that how their Ads are performing in their selected audience with each activity in manual as well as graphical manner with complete measures. • We share information with those service partners who supports us financially and technically to improve our products or to grow our business. If you purchase any product on our site then seller will receive your information as well as other information like payment, profile and other information to complete your order. • We provide information to our research team and IT team members to conducts survey and research that how can our platform be better than others in all manners. • We also provide information to our Law department to protect the rights of our users. You can have complete faith on our policy that we will take all necessary action to investigate or to take action against any illegal activity done by anyone. How you can you manage or rectify your Information

1.Rectify your information

We provide account settings to users to modify or rectify their details like name, profile photo, password, transaction password, bank details you can also contact us to change any of your details, our admin will help you as per your choice and download your all information.

2.Retention or deletion of your information

We keep your information until it is not required to provide our services or your account is deleted. We delete or deactivate your account as per your demand .if your account is deleted then your all information cannot be recovered in future but if your request for your account deactivation then you can activate your in future at any time, since if your account has deleted permanently then all of your activities done like post shared ,Ad posted ,your messages, your friends records etc. cannot be recovered later. If any of your friend has posted something related to you then that is not a part of your content and you can’t delete that information.

When you delete your account then we will keep your information for 30 days and after some of your information will be deleted permanently but some information of your will retain with us for future if any legal dispute or abuse arises to meet regulatory requirements.

How we react to any legal matters

When we any legal matters related to us in any manner and we find that it is according Law. We share the information with regulators; all process will be completed as per India’s Law. We also respond to legal matters outside of India when we find right that it is according law of that jurisdiction.

When we find any illegal activity on our platform which may harm or may be fraud according to our policy then to prevent then we may require to share the information of your as a part of investigation.

We will keep record of information for at least one year to respond any legal enquiries or investigation and also if anybody try to harm our system repeatedly even after being their account deleted.

How we work as a global service provider

We share information all over the world with our partners and Talkfever companies to provide uninterrupted services to all users. You information may be transmitted to other countries as per requirement by this policy. We work on proper contract basis terms and conditions with our partners.

How we notify you about changes in policy

We may require to update policy from time to time as per rules. We will notify you about any changes in our policy to your registered email and updated policy can be seen anytime on our website. After your confirmation to be agreed to our new policy you will be bound to our updated policy.

  2. Extract from the memondum of association of Talkfever Social Media Limited

    The conversion of the firm into public limited company followed by the no objection certificate from registrar of firms and societyand public notification published in leading newspapers in both Hindi and English languages as per the direction, guideline, rules and regulations and requirement of the ministry of company affairs (MCA):-

    And Whereas the parties hereto have been carrying on the business of “Social Media” under name and style of “M/S TALKFEVER SOCIAL MEDIA” (herein referred to the said firm and company) on the terms and conditions contained in the partnership deed originally executed on 09.07.2019 modified from time to time.

    The above partners have decided to convert “Talkfever Social Media” (proprietor firm which was running by Shri Shiv Ram Verma since 01.09.2017) into Partnership Firm with effect from 09.07.2019 modified from time to time on the terms and conditions mentioned hereunder:

    Whereas said firm carrying the business of “Social Media” under name and style of “M/S TALKFEVER SOCIAL MEDIA” and whereas all the parties hereto who are members of said partnership business, for sake of smooth working and better and effective management, improvement and advancement of business have agreed and decided that all the members of the partnership (being a joint stock company within meaning of the said terms as defined by section 566 of the Companies Act 1956) should register the said joint stock company under part IX of the Companies Act, 1956 for running said business of the firm uninterrupted on and continuing the said business of the firm uninterrupted into joint stock company    and to abide and    be subject to the declarations and regulation contained in the Memorandum of Association and Articles of Association

    4. To Help Business Entities In Increasing Brand Awareness, Product Promotions, Market Traction And Customer Engagement On Estimated Budgeting, Billing And Invoicing Methods Topromote, Boost, Engagetarget Audience.

Recruiting Professionals, Associating Ad Agencies, Integrating And Affiliating, Providing Tools, Algorithm And Ai Tech Solutionsfor Advertising Campaigns, Offer Of Discount Or Cashback Or Loyalty For Low Cost Ad Campaigns And Activities. Developing Social Ad Strategies To Increase The Social Involvement.

    6. To Create Or Provide Solutions For Boosting Sales Of Business Entities Such As Online Or Offline Marketplace, For E-Commerce Portals Or Websites Or Creating Marketplace Such As Adbaazaar Or Social Baazaar Or Organized Events Or Licensed Aggregators And Promoting Or Pitching Their Business Turnover Or Sales Or Product Offerings Or Increasing Brand Awareness.

  4. Talkfever as a Social Media Intermediary Platform
    Talkfever is a Significant Social Media platform and has implemented policies and procedures to comply with the requirements of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (hereinafter the “Rules”).
  5. Due Diligence
    1. Talkfever’sPrivacy Policy,Terms & Conditions of Use andCommunity Guidelines are available on its website as well as within the Talkfever App. Talkfever will inform users of any changes in the Policies at least once in a calendar year.
    2. In addition to other requirements prescribed by the Rules, Talkfever Policies specifically prohibit users from publishing content that is

      (i) invasive of another’s bodily privacy or harmful or harassing on the basis of gender especially children; or
      (ii) is patently false or misleading but appearing as a fact; or
      (iii) impersonates or deceives or is false with the intention of causing injury or wrongful loss or harassment wrongful gain or fraud; or
      (iv) threatens the unity, integrity, defence, security or sovereignty of India, or
      (v) violates any law.
      Talkfever will endeavour to deploy technology-based measures, including automated tools or other mechanisms to proactively identify content which falls within the above categories and others.

    3. Orders by a court of competent jurisdiction or Appropriate Government or its agency or takedown or any other purposes should be addressed for compliance to the Resident Grievance Officer with a copy to Nodal Contact Officer and Chief Compliance Officer.
    4. On receipt of a written request for information from a lawfully authorized government agency clearly stating the purpose for which it is required, TALKFEVER shall provide such information or assistance in its control or possession to the government authority within 72 hours.
    5. In compliance with the Rules, registration information from a user and/or information which has been removed or to which access has been disabled, shall be retained by TALKFEVER for a period of 180 days from the date of cancellation or withdrawal or removal or disablement.
  6. Additional Due Diligence
    1. The physical contact address of Talkfever for the purposes of receiving communication addressed to it under the Rules is 1st Floor, GTB Tower, University Road, Gwalior, Madhya Pradesh, 474011, India.
    2. TALKFEVER has implemented the following mechanism for dealing with grievances:
      (i) Grievances relating to violation of the Rules must be addressed to the Resident Grievance Officer atredressal@talkfever.com with a copy to the Chief Compliance Officer atcompliance@talkfever.com. The complaint must contain such information as is necessary in order for TALKFEVER to investigate and take action.
      (ii) Reported grievances will be acknowledged within 24 hours of receipt along with a unique identification number. Grievances will be disposed of within 15 days from date of receipt. Wherever practical, information on action taken or not taken by TALKFEVER may be provided to the reporter of the grievance.
      (iii) Grievances by an individual relating to exposure of their private areas, full or partial nudity or depicting such individual in any sexual act or conduct; or impersonation in an electronic form, including artificially morphed images will be acted upon within 24 hours.
      (iv) A monthly compliance report containing information as specified by the Rules will be published on the website under the linkhttps://www.talkfever.com/compliance
    3. Users may opt for voluntary verification of accounts using an active Indian phone number. All such requests may be sent to redressal@talkfever.com or raised within the Talkfever. A visual identifier will be shown against the profiles of users who have voluntarily verified themselves.
    4. Publishers (as defined under the Rules) of news and current affairs content should take note of the information statement in compliance with the Rules can be found under the link https://www.talkfever.com/compliance. On confirmation by such publishers of compliance with the Rules, Talkfever will display a visible verification mark against their profiles
    5. TALKFEVER also displays a visible verification mark on content that is advertising or sponsored or is exclusively controlled.
    6. TALKFEVER has appointed Indian residents to ensure compliance with the Rules:

    This Compliance Statement is with reference to Rule 5 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (hereinafter "Rules") and applies to Publishers of News and Current Affairs Content (as defined under the Rules). Please note that according to the Rules, if you are a Publisher of News and Current Affairs Content, then in addition to the common terms of service for all users, you are required to furnish the details of user accounts on the services of intermediaries to the relevant ministry prescribed under Rule 18. If you have already done so please inform Koo by sending a mail to redressal@talkfever.comand we will provide a demonstrable and visible mark of verification as being Publishers against your profile.

This notice is made by TALKFEVER SOCIAL MEDIA (hereinafter referred to as “Talkfever”, “we”, “our” or “us”).
This Terms of Service (the “Agreement”) sets forth the terms and conditions that apply to your access and use of the internet website located at www.talkfever.com (the “Site”) and the services available thereon (the “Services”).

BY ACCEPTING THIS AGREEMENT, EITHER BY COMPLETING THE ONLINE APPLICATION PROCESS BY CLICKING A BOX INDICATING YOUR ACCEPTANCE OR BY EXECUTING A SUBSCRIPTION THAT REFERENCES THIS AGREEMENT (THE “SUBSCRIPTION”), YOU AGREE TO THE TERMS OF THIS AGREEMENT. IF YOU ARE ENTERING INTO THIS AGREEMENT ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND SUCH ENTITY TO THESE TERMS AND CONDITIONS, IN WHICH CASE THE TERMS “YOU” OR “YOUR” SHALL REFER TO SUCH ENTITY. IF YOU DO NOT HAVE SUCH AUTHORITY, OR IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, YOU MUST NOT ACCEPT THIS AGREEMENT AND MAY NOT USE THE SERVICES.

By accepting this Agreement, you agree to be bound by the terms and conditions of this Agreement which may be amended from time to time in the future.
Talkfever may update this Agreement at any time, without notification to you, and you should regularly review this Agreement by accessing the Site. Your continued use of the Site and/or the Services shall be deemed irrevocable acceptance of any such revisions.

1. Ability to Enter into this Agreement

In order to enter into this Agreement, you must have reached 18 years of age in India and/or the legal age of majority in your jurisdiction of residence or possess legal parental or guardian consent, and be fully able and competent to enter into the terms, conditions, obligations, affirmations, representations and warranties set forth in this Agreement, and to abide by and comply with this Agreement. It is your responsibility to ensure that you are legally eligible to enter into this Agreement under any laws applicable to you in your jurisdiction of residence or otherwise. If you accept this Agreement, you represent that you have the right to be bound by it.

2. Your Profile Information and Account

You agree and understand that you are responsible for maintaining the confidentiality of your password which, together with your email address allows you to access the Services. That email address and password, together with any or other user information you provide, form your “Profile Information” and allow you to access your account (“Account”). You agree to provide true, accurate, current and complete information about yourself, and you may not misrepresent your Profile Information.
Your right to access and use the Services is provided personally to you and is not transferable by you to any other person or entity. You agree to not to disclose your password to any third party. You are solely responsible for all activities that occur under your Account or under your Profile Information. If you become aware of any unauthorized use of your Account or Profile Information, you are obliged to immediately notify talkfever.
By providing us with your e-mail address, you agree to receive all required notices electronically to that e-mail address. It is your responsibility to update or change that address, as appropriate.

3. Submission of Content

The services available on the site enable you to provide or upload content, including but not limited to text, images, video, data, and other information (Say content), to Talkfever for the purpose of providing the Services. You acknowledge and agree that you are solely responsible for all Content you submit, provide or upload and the consequences for submitting, providing or uploading it.
Talkfever will use Content you upload solely in connection with providing the Services to you, and for no other reason. You agree that by uploading, or otherwise providing any Content on or through the Site and/or the Services, reproduce, process, display, all or any portion of such Content, solely in connection with providing the Services to you.
You must agree that your content or images or videos or otherwise must be in accordance with the social community standards. Your content should not harmful for social safety, religion, individual social image, individual character, caste, creed or color, threats or in others ways. You will neither be allowed to post abusive text content or nude images nor inspire others. In case of failure to follow the social community standards, we have right to block or delete your post or we may block your users account.
Once your account is blocked; you will not be able to use your account or access the site for a period of 20 days-60 days. During the blocked period; no any promotional cashback or rewarding streams or other offered benefits will not be considered.
On expiry of blocking period; your account may consider to allow you to use on your written apologies on official email admin@talkfever.com.
On repeated 3 violations; your account will automatically be permanently blocked or deleted and it cannot be revived in future in any case.
On or before the day of blocking of your account, if you have same part of benefits whatsoever it may be; will be considered zero and will be declared unused or unpaid against the penalty for violations of term of use.
The above terms and conditions are not only related with your post but also applicable on comments or chat/messenger.

5. Termination of account

We reserves the right to terminate services either paid or free choosen by you even after approved by talkfever administrator; if we found that you or an individual or any person who are not able to following terms or violating community standard guidelines or producing/creating/promoting non parliamentary contents or involving in anti-social activities that harmful for society in general or in person or producing fake/false defamatory content intentionally against any person/group of people/institutions/corporate without evidences or permitted document from authorities or creating unrest situations or involvement in misleading people or involvement in anti-campaigning against talkfever or misguiding movement or creating fake or false communication or producing prohibited contents as per the government or any content falls under the cyber crime guidelines or receiving instructions from governmental authority/authorities to banning any person or deleting account of any person or persons for ongoing proceedings under the constitutional penal code against breach or violation of constitutional law and legislation of India or outside India and/or in any case of non-compromising or intolerable offense/attitude/behaviour or consideration of repeatability/severity of community reports and recommendation of more than 50 people vote against you/your firm(s).

6. Deletion of account

You can delete your account temporarily or permanently at your sole discretion at any time. Alternatively; you can hide your account for specific period and during that period your profile will not be accessible to anyone.
If you want to delete your account; your complete data will be sent to recycle bin and your account shall remain deleted temporarily and will not be accessible to anyone. Your account will be recoverable for next 30 days for precautionary reasons in the event of change of mind.

If you don’t want to revive your account within 30 days; your account will be deleted permanently and can not be recoverable in future.

7. Right to accept or reject

In case of free look period is allowed; the refund of paid amount will be credited directly to the bank account within 30 to 45 days in general or typically at the specific terms of particular services.

Free trial period means the provision to get satisfied with the results or responses of the premium services without any payment of prior charges. Once you have taken free trial; no any trial will be given in future for the same service.

·         Blocked spend and under delivery: We don't give refunds for the inability to create new ads, view results, optimize delivery or where there has been under-delivery of existing ads due to a system bug. We don't refund for blocked creation of ads.

·         Interface outages and failed API calls: We won't consider refunds for the inability to create ads, view results or optimize delivery based on results. We won't refund where system bugs, affecting interfaces, display in an obvious way that advertisers can see and correct for.

In case of premium subscription upgraded before expiry period of the previous subscription; no refund and/or any adjustment or any redemption whatsoever shall be considered for the premature termination of premium services.
